My boyfriend recently got arrested for section 39 assault. He has a caution for assault already. He is at the magistrates on Friday and would like to know what to expect? Will he go to prison?

If this is his first appearance for violence then it might just be Community service or even a fine.

In some ways it depends on who the victim is, if it was you or someone from an ethnic minority then these are indicators of future risks either to you or to people from ethnic minorities. If this is the case then it will be dealt with more seriously. Under these circumstances supervision and anger management/thinking skills courses are an outside possibility as a sentence of the court but not if you were the victim, there is another programme for relationship violence.

Unless it was particularly nasty (and it shouldn't be common assault if it was) then I wouldn't expect custody.

Unless he can show a just cause, and it better be a good one, then it is more than likely he will be taking a holiday. He needs to get anger management. Anyway the trip away might teach him you can't go round doing those type of things. Do you really want a boyfriend who keeps having problems surrounding assault, how long will it be before you are the victim. Good luck

Doubt it for that it is only a minor offence max 6months more likely suspended sentence or community service.

he could get a fine or maximum prison sentance of upto 6 months or both. if he offers to go to anger management then his sentance could be reduced. good luck
