i moved to America in 2005 i was here for only 131 days that year. i didnt know i was eligible to file taxes. Now i know, i'm filing this years' taxes. Can i file taxes for the 2005 year? Can i get a refund for that year?Should i file both returns at the same time?

Ignore the 2 prior responses, please. The are incorrect. "Skip" is incorrect on the penalty, there is never a penalty if a refund is due you. "SG Elite" posted gibberish for reasons only known to him or her.

If you had income that exceeded the filing requirements you MUST file a tax return. You will have to file the 2005 version of the tax return. You can get prior years' forms from the IRS website.

If you have a refund coming there will be no penalty for late filing. If tax is due with the return there will be a penalty for late filing AND penalties and interest for late payment of tax.

While you could theoretically put both the 2005 and 2006 tax returns in the same envelope you should mail them separately to avoid any possibility of confusion.

You can't file returns for previous year. If you do you may be charged for late-filing. I suggest you connect with the tax guys and have them send you an appropriate form to file your Year 2005 income. There may be penalty. I suggest you explain to them that you were not aware that you need to file and see if they can give you a waiver.

Yes you may file for last years taxes. If you are due a refund you will be able to get one. You will be charge a fee for filing late, but if it exceeds the amount you are getting back it will work out fine.
