Here's a little more about the situation. The mother is either going to sign custody over to us (a family member) or dss is going to take custody of him. What would that mean for us?What would be our rights as far as our control over visitations and other importants decisions involving the child. And what could she do to try to get him back later on?

To add a little more information on this. This has been an on going situation with her she had him taken away 11 months ago and we got temp. guardianship of him for 9 months and she finally got custody back of him. She took him back for 2 weeks and called us to come get him because she couldn't pay her bills to take care of him. We had him for another 1 1/2 months. She came and got him again and had him exactly 2 weeks again and called us again because her power was shut off. So now the caseworker has called this meeting to find the best placement for the child because she has failed to provide him with stability. And the only stability he has ever had in his life has been with us. He was 13 months when we first got him and he will be 2 in 2 weeks.

It means she is handing over her child. You will be primary decision maker for anything that goes on this this childs life, this child will be yours. But being the childs biological mother, she may be able to get more visitation or get back in the childs life later. If this is something you want to do do, make sure you do your reseacrh, talk to your lawyer to see how to prevent anything bad from happening.

So she is signing temporary custody to you then, it sounds like. It really means that visitations should be set beforehand, including any important decisions to be made be it medical, educational, etc. If she is unreliable and just doesnt want to have her child anymore (sad, really) then maybe you could go for her signing away her parental rights and giving sole and permanent custody to you. That all requires attorneys. If you stick with the temp custody arrangement, then she will be able to attempt to get her child back any time she feels like it. Not really a great way to live, is it?

if she signs custody over to you then you have complete contol over every thing just like you had given birth to the child and you can then decide visitation or if you feel its in the childs best interest to have no further contact with his mother then that is your choice and i know money is not your main concern but the state you live in may pay you to care for the child.She can forget getting him back later after she gives you coustody.

It is according to what kind of custody you are getting. (Full or temporary) Make you a list of questions and call DSS and talk to the case worker about all the issues you have with this. They should be able to answer all your questions.

Yes you get to pretty much get to decide
everything. Because I did it with my sister I know. Yes she could get her back down the road but she will have to prove herself to the court. I had different circumstances though, I worked too much, I guess I was a unfit mother. If you would like to email me I will discuss some things further.
