I recently got married to a Spanish women. We have all but a few documents gather ready to file for an adjusted statues so she can get her green card and SSN. The problem I am having is how to file my taxes? She is not eligible for a ITIN # and there is no way to get a SSN # before the tax deadline? Should I try filing "married filing separate" and then do an amendment or should I file for an extension in hopes that I can have here SSN # in time?

File an extension, and then file as soon as you get the SSN. If by some chance the SSN does not come in before the six month extension is over, file MFS and then amend the return when the SSN comes in.

Well, you've got two choices. If you're certain that her SSN will be approved AND you're certain that you won't owe when filing a joint return then filing for an extension would be the way to go.

If there's any doubt on the SSN then filing Married Filing Separately now and amending it once her SSN comes through would guarantee that you can't be penalized for late payment of taxes by the IRS.

If you don't have a local IRS office you can visit (and you would need to get there as early as possible this time of year), you can call the IRS toll-free number and get an answer to your question. I don't have my book handy right now, but I believe that it's 1-800-869-1040. You can check in the front of your phone book (white pages with blue edges) under United States Government / Internal Revenue Service, or look in the booklet that comes with your tax form.
