if the judge missed the initial hearing and has yet to sign the papers do I go ahead and start paying or do I wait until the judge signs the papers?

You need to start paying right away because:
1) Your child needs to eat NOW and not wait for the judge.
2) No matter when the judge signs the papers, if you didn't pay the child support starting from the day of your legal separation, the judge will order you to pay the child support in arrears (all the back child support that you owe) in one lump sum.

If your smart, you'll just start to pay. Or at least take the money that you would have had to pay, and place it in a savings account. That way, when the judge finally gets to signing the paperwork, and then adds that you owe back child support, you'll have the money already there. And, you can keep the interest.

It is not in place of course untill the judge signed it, but on a moral issue, why would you not expect to support your own child ???

Pay. It's your child. You should want to take care of your child. Just make sure you pay be check or money order, though, so if it ever becomes an issue you will have proof.

after being in a similiar situation I would suggest paying the full expected amount....if you overpay your account will be credited toward the next payment....if you kid/kids are young be ready for a long haul, it's been 9 years for me a 1000.00 a month, plus extras...do the math..

call your caseworker and ask about it. if you are late, double the payment and make sure its current.
