After mum died, my oldest brother want me and my youngest brother live with him and our third older brother. However, my second older brother want us to live with him. Me and my youngest brother prefer to live with our second brother as he's kinda of a cool type of brother compare to our eldest brother which is known as a very strict brother. I had a history being slap by my eldest brother when he caught me smoking. I really want to stay with my second older brother. Can we make our own decision here?

I doubt that at your age you would be able to simply choose whom you wish to be with. However, I'm sure that your opinion Will be weighted by the judge in the case, especially the more mature you appear to him/her.

You might also be thinking of reasons to support your decision to want to have this brother as your guardian. Good luck.

Your second brother may be cool but does he really know what's best for you - certainly sounds like you have a very caring first brother albeit strict. You will still be able to go to your second brother to have fun but please go where your eldest brother will be a parent figure whether you like it or not. He only wants you to be OK and grow up safely.

Take care and I hope that you make the right decision. It can't be easy what your going through and you need the stability in your life right now no just a good time before too long you may go off the rails with all that's happening right now, your eldest brother cares and wants to make sure you don't do that.

In answer to your question yes you can make your own decisions but please make sure you make the right one!

Your only and immediate relatives are your brothers. You have to heed to the advice of your elder brother for your life's betterment. By opting to reside with your second brother will make your elder brother feel bad. As the head of your family you should be taking the big one's advise at all time until you can stand in your own. Remember your father may return to you again, to accept him you should lead to a diligent life to keep him with you.

Todays wise choice is your future's balance of life.

If a family member of legal age doesn't file a guardianship
petition with the court in your county, then a court judge will
appoint a guardian from outside your family and legalize him
or her to handle all issues dealing with your situation, ie:
housing, schooling, clothes, food, medicines, health care, etc.
That's the way the system works in the states.

Gadd, keep things simple.... That said, yes a Minor can 'Petition the Court' and request a specific guardian, it is a practice going back to Roman times.

I'm not sure about British laws, but here in America, a child can chose his/her guardian at 12 years of age.
