Yesturday a woman crashed into my car that I hadn't have the time to get insurance to and because I didn't have insurance she tried to blame it on me when it was really her fault. All of the witnesses around clearly saw when she hit the side of my car, and they gave me their information because they are willing to testify. The woman didn't want to call the police because supposedly she tried to help me, and I didn't call neither because I had never been involved in a car accident and because I don't know whether I have rights to fight my case. The only information I got from the woman was her licence plate number. I didn't have insurance at the time of the accident, but I have several witnesses; what are my chances of going to court and winning the case? My question concerns about the accident and not my reasons why I don't have insurance. I would really appreciate it if someone that really knows and/or themself or known someone that has been in my situation could help me. Thank you.

I was in the same situation. Some guy hit me & I let him go. Come to find out they don't have to pay you unless you take them to small claims court which takes alot of time & money. Whatever you do, I would get a cheap insurance policy before you try to proceed. You may want to try a website that compares multiple companies at once to get you the best price. I am paying less than ½ after I did.

If you have witnesses you have a very good chance of winning. You really should have called the police, but, you didn't. If you have the license plate # you can look up that and get info on the woman who hit you. If you had insurance on another car, the insurance company usually gives you 30 days to list the new car and in the meantime the car is insured.

Because you have witnesses you have a good chance in court if they go, you should have called the police, you would have received a ticket for no insurance but she would have one for the accident. You also should have her name, license number, type of car and insurance company name.

If the police had been called, you could have been cited for being an uninsured driver. I don't know if you still can. HOWEVER, the insurance of the person at fault pays for the accident. In several instances where I have been hit by another person, I called THEIR insurance and told the insurance company that their driver had been at fault in an accident. Then their insurance opened a claim, and after deciding that their driver was at fault, paid for my car, all without ever discussing my insurance at all.

IOW, if she was at fault, and you can prove it, her insurance pays.

If you get a court involved you both could get into trouble for fleeing the scene of an accident unless the damage was less than $500

tho she hit you in Pa it's your fault and you will get a suspension and have to pay for her car.
A couple of suggestions first find a cop in your area and walk to him and ask the same question. do not give information tell him it's a general question.

or you can Fry her before she does you go get insurance asap you have her plate number report it as hit and run. She didn't stop no witness and you THINK that's the right plate number you wrote down.
