On the ACU's, the US Flag Insignia is worn on the right shoulder pocket flap. Since that flap is above the velcro where the combat patch goes, then yes, the flag stays above the patch.
I can understand your confustion, since AR 670-1, page 241 clearly states that on utiltity and organizational uniforms:
If the SSI–FWTS [combat patch] is worn on the right shoulder of the utility uniform, the full-color U.S. flag cloth replica is placed 1⁄8 inch BELOW the right shoulder sleeve insignia.
...and the illustration (28-136) supports this. But the reg has not been updated to include ACUs. A message came out (see first link below) that updates the reg with the ACU flag and patch wear info.
