father has said after 2 years he is not the father of my child as he is in a new relationship and is going to have a new baby and does not want to pay for mine, he also said he was forced to put his name on certificate, can he force me to get the test we are in scotland

I have said the test can be done but I dont trust him as I think he will send someone else to take the test for him , I want to tell his lawyer this but I feel if I do they will take me to court

Unfortunately, through his lawyer and the legal process, he can force the dna test unless you can prove it would be detrimental to your child's health - which is hugely unlikely. I'd say, get the test done. It won't harm your child at all and you will have your proof (forget about what he wants for now if he's a big liar) and you can go to the CSA if you haven't already, and they will force payments from him to you by claiming them directly from his employer.

Also, if you ring the citizen's advice they will give you the number of local lawyers who will give you one session (or phone call) of free advice as to how you could have him prove it's him turning up for the test. I don't really know how this would works but ask them about getting at least a reliable witness in the room to confirm his identity.

It's a shame when things get this bad but use this situation to your child's advantage.

He would need to prove reasonable doubt. Assuming there is none the test will not harm your child and will be good for his future welfare, finances etc.

With regard to his having a friend take the test for him, you would be wise to suggest that they both take the test together. He can comfort his/your child during the test that he is inflicting upon them! Only fair and reasonable. Obviously this assumes he currently has a relationship with the child that would put him in a position where he could comfort the child!!

My own husband has never been great with the babies and if any tests were done he would be as good as a chocolate fire guard!!

friends experiance "said yes to the dna test this would of been done at his gp's and his identity confirmed before hand, he did not turn up gave him another appointment, he again didnt turn up with no acceptable reason, then because he signed the birth cirtificate they said they would use that to confirm he was the farther as he didnt attempt further proof. so child didnt have to have test after all"
