if he tries to hurt you, its self defense. however if he has attempted to hurt you in the past, you should report him to the police.

You would go to jail until you're bailed out (unless they don't give bail, which they might not for such a serious crime).
You might end up in prison, especially if they prove that you planned to do this.
At best, after being in jail (and your son taken away while you're there), IF you're found not guilty, you'd be set free. AFTER the long time between your committing the crime and the end of your trial.
If you think you're in real danger, get to a shelter, with your son, until you can move somewhere else (don't tell him where you live).
Pick up a phone book, and call a women's hot-line; they will advise you.
Even if you eventually got off for this pre-meditated crime (your asking this question proves it would be pre-meditated), you would have done time.
And putting your son through the trauma of watching his mother shoot his father (even though the father is a batterer) is NOT good for your son.
You aren't thinking clearly.
There is help out there for you. Use it.

I would normally say that if you NEED to you can shoot someone in self defense- keeping your babies safe is the most important thing- then okay, keep the babies safe. But cops are good at figuring things out and if you do shoot him, they'll find this on your computer and they'll know you've looked in to shooting him. That's premediatated. You'll go to jail for that. So I would say you need to find a safe house now. Get out of where ever you are and protect yourself and your family. You won't be able to keep your babies safe from behind bars.

It depends on the state you are in. As a rule, you have a right to self defense, but some states respect that right more than others. For example, in Indiana, you can shoot someone for refusing to leave your property, but in California, doing so get you sent to prison.
Call your local police department and ask them if it is acceptable to use deadly force in the defense of your home or your life.

one way you can keep him away is by filing a restraining order to keep him away. you have to make sure this is what you really want. if the guy violates it, a phone call will put him in jail, BUT a family law jugdge will still order "supervised" visittation for the kids, especially if the problem is just between you and the dad. i have seen family law judges make some messed up decisions, even when the mom is in the right. the law is "DECISIONS ARE MADE IN THE BEST INTEREST OF THE CHILD, NOT AT THE PARENTS CONVENIENCE"

it's not okay to premeditate the shooting of your baby's father (do you not think something like your question here would be used against you?)...if he's trying to physically hurt you, call the cops, that's their job...if you kill him, even in self defense, there would be a trial and the child would be taken away for the duration, etc...c'mon, have you really thought about this? use your head woman...

Call the police and have a judge issue a restrainning order that will prevent him from coming within 100 yards of you or your son. If he comes closer you simply call the police and he goes to jail. It might be a good idea to find someplace else to stay so he cannot find you and that way you avoid the whole issue.

Yes you can, but first get a restraining order against him and if he violates that, then you have every right to do whatever you have to. But first, try to find a better solution to your problem, what would your child think of you, knowing that you hurt of killed his father. I do wish you the best luck with this problem, but try the restraining order first. I don't want to see you do anything you will regret later.

Don't wait til it gets to that point and you gots-ta shoot him. Put a restraining order on him and document all phone calls, threats, or harm he causes you. Then if you do have to hurt him, you're self defense will hold up.

Get a order of protection ,then if he comes near you and you shoot him it will almost definately be considered self defense.
