If the car is within its warranty period, and the recommended maintenance has all been followed, the switch has not been turned off, it was a frontal collision, and the speed was in excess of about 24 mph, they might be liable. In most other cases, they would not be, and any injury you sustain from not wearing a seatbelt is considered to be your fault, or the fault of the driver if you are under 16 (in most places).

Yes they most likely are but make sure that on the passenger side it was not turned off (some vehicles have this option, mainly regular cab pick up trucks). But it also depends on the collision you were in, the force of impact and the location of Impact as airbags are supposed to deploy at a certain speed and in certain accidents, mainly head on collisions.

That's where the seat belt comes in. Seat belts are designed to save your life. The airbag is just supplemental protection. Someone who depends entirely on the airbag is making a mistake.

If it is within warranty - yes they are liable. If it has been regularly maintained by an authorised franchise dealer in accordance with the manufacturer's maintenance schedule, then yes they are liable.

If not - bad luck.

I would have thought so, that is something we never thought about ours didn't work on a Peugeot when our daughter had an accident
