someone else w/out a license was driving my car and the police impounded it, is there a law that i have to wait 30 days to get it back from the tow yard or can i pay and just get it out? please help im really frustrated this happened in CA. thanks in advance

i am going to try to get it out monday but i wanna know if there is a mandatory 30 day waiting period one of the tow companies said wait 30 days :(

ok for all of you that are accusing me of ohh no letting someone w/out a license drive well they had a permit and are not like 15 so they were older and had a permit so is there anything i can arque to get my car back?

I do this for a living, in CA, so here it is:
The officer can take your car under the authority of two different vehicle code sections.
14602.6 -IMPOUND- places a minimum hold on your car for thirty days.
22658(p) -STORAGE- let's you get it now.
In either case, you must go to the law enforcement agency first to get a release. CHP charges nothing, some PD's charge up to $150 for the release.
Then you can go to the tow yard and pay their fee's to get your car back. Only the registered owner can do this.
*IF* your car was taken for an impound, and you want it released sooner than 30 days, I recommend asking for a sergeant and relating to him/her that you had no knowledge of the driver's license status or of the fact that the guy was even driving your car. (it's a long shot, but you have nothing to lose)
It's also important that you know this: the impound authority is for suspended drivers only.

You need to contact the company that is holding your vehicle. If you don't know, contact the law enforcement agency that had the vehicle towed. They will have a record of which company towed the vehicle. They usually require proof of ownership. You need to find out exactly what they require and what the cost will be before you get there. Most wrecker yards charge an impound fee and a fee for each day they hold the vehicle. They will also require a licensed driver to drive the vehicle off the yard.

CVC 14602.6 allows for a 30 day impound of a vehicle driven by a person whose license has been suspended or who never had a license. The owner of the vehicle has a right to an Impound Hearing to be conducted by the impounding law enforcement agency.
In general, you - the owner or responsible party - are required by law to make reasonable inquiry as to the license status of everyone operating your vehicle. If you failed to do this, the agency is not likely to release the car. But, there might be circumstances that could convince a sympathetic hearing officer to release it.
As a point of reference, I have never released a vehicle to an owner unless I was required by law to do so (such as the driver obtained a valid license or the vehicle was later reported as stolen).
Check with the law enforcement agency that had the vehicle impounded and schedule an appointment to speak to someone about it. They are REQUIRED by law to provide you a hearing.

I've never heard of that and 30 days in a tow yard is going to be an expensive storage fee. I'd get is ASAP.

were you with the person when your car was impounded? if you were then you will just have to pay to get your car back. if you were not with them did you tell them that it was ok to drive your car? if not then i would tell the judge or who ever that you were not aware that he or she had your car. i had borrowed my sister's car and her daughter stole the car out of my driveway and i had to pay the impound fee's, so i would get your car ASAP.. good luck

bullshit! you do not have to wait 30 days. the quicker you get the car the less expensive it will be you know overnight charges and all.
