Yes, it has b een proved that herpes, both oral and genital can be spread 10 days after the outbreak cleared up.
No kissing, and only condoms during that time frame.

Unfortunately yes. The virus lives in the human body and can be transmitted even if there is no outbreak. However I believe I read that chances are lower when there is no outbreak.
