Yes you can. The penis still "leaks" semen during intercourse. That "leakage" can contain sperm that will get you pregnant.
P.S. I am a guy on my wife's scree name and I will tell you this....EVERY GUY KNOWS WHEN THE CONDOM IS ABOUT TO BREAK!!! It gets really tight at the top and bunched up at the bottom. So if he gives you the ol' "I didn't know it broke" don't believe him.
