From my understanding, you have to ask for the test to be given and sign off to agree to have your blood tested. Or, if they present it to you, you have to still sign off on the paper which suggests you are giving them permission to do just that. I've been hearing so many people say that they don't have to be tested because when they were in the hospital for an illness, they were tested and don't have to worry about it. What are your opinions?

I don't know why people assume that but you are correct that a patient has to sign a consent form before they can be tested. It is illegal to run an HIV test without the patient's consent, unless they are unconscious and have an open wound where a healthcare worker was exposed to (ie, blood spurting in an EMT's eyes). Other than that, unless you sign that form, then no, they cannot test you.

well I do know they test when you donated blood or an organ. When the symptoms arise they do test for it. but not sure something simple as a browken leg. some places may test regaurdless.

Did they ever get an actual result back? Or just assume that since they didn't hear that they had HIV, that they didn't? Maybe they shouldn't assume they were tested.
