I was recently rear ended and didnt know if I should file a claim or not. Only my rear bumper if scratched and dented. My dad told me to "take the check" but I didnt know if taking a check and not fixing my car would be considered fraud. Thanks.

You are not committing fraud by taking the money and not fixing your car...in the long run when you go to sell the car or trade it in that dent and/or scratch will lower the value of the car if it is not fixed, so the money you took makes up for that. IF, however, you do not know the name/ins carrier of the other person then I would NOT file with you ins. company. They might raise your rates or drop you altogether based on your claim history.

Claims raise insurance rates, more so because everybody has to pay for it. Even not at fault drivers with perfect driving records have a small percent tacked on for this, and the more claims that are filed, the higher the insco's go, and that's the way it is. Our premiums pay mostly for the Insco's to exist, the Insco is a business so we pay their rent, their electric and phone and water, the clerks wages and the furniture in the office long before we even reach the amount they put aside for claims, and rest assured if someone is going to lose money in this transaction, it wouldn't be the Insco.

But it is not fraud because the damage to your car will affect the price should you try to sell it, and more likely than not the effect on the price will be about the same amount as it would be to have it fixed, and it is ultimately your choice what you do with the money.

With all that considered, I probably would file depending on the damage when compared to the entire car. If it's just another scratch among dozens then probably no, but if it's the only scratch and dent and the car is otherwise awesome, then probably yes.
