and thats where my baby spends most of the time when im in school or work what can i tell the judge wht kind of crime is that?

Well, I would call the police when this happens because when you do go to the judge you will have proof that these things are happening then he will not be able to be around you or the child. it seems like it might be better that way, the ways it sounds.

This is called criminal mischief and is a misdemeanor offense. Call the police as soon as you see him there and if at all possible, either you take a picture of him when he is doing it or have a neighbor take it if you are gone.
