My husbands youngest daughter died in 2002, and the local child protection office is convinced that he murdered her and took our other kids. The sheriffs office and the coroner ruled the death accidental. Does anyone have any suggestion on what I could do to change their minds? I don't want to start people arguing with me, my husband did not kill his daughter, and I didn't either. He never hurt her, he even got custody of his girls over their mother in 1999. Please people don't start anything with me because this is a touchy subject and I couldn't handle being verbally abused again on a board like this.

The coroner ruled the death asphyxiation(sp?) she had a hotwheels tire in her throat and a bag over her head. The children are with my mother and I want to fight to get them back to me. But I feel that this is a loosing battle, because like one of you said, it's legalized kidnapping. The took my youngest daughter from me in the hospital when she was 3 days old and their reasoning was that I was neglecting her! Even I know that this isn't possible. Anyone can IM me or email me I would be appreciative for friends as I don't have any and would explain the situation in greater detail.

I think that her older sister with severe mental issues did the bag thing, but don't bring that up to my husband...he refuses to think that his oldest could do anything like that, but everyone else believes that.

If he hasn't been charged with anything, it's amazing that the child protection services stuck their nose in it, especially since the death was accidental. My best advice to you is talk to a lawyer ASAP. I'm very sorry that you are having to deal with this, as well as people who are saying negative things to you. If the sheriff's office and the coroner's office have both ruled the death as accidental then I really don't understand why the child protective services there aren't getting the message. I am assuming that they have received those reports from the two other offices, and if not I would be making it a point that they do get it. If they continue to harass you about it then I would consider speaking to a lawyer about it and see if there is anything I can do about it from a legal stand point. Unfortunately if you are speaking about changing people's minds in your community then I highly doubt that anything you or your husband do is going to change their opinions about the whole thing. It's sad to say but many people today are to eager to believe anything negative about someone else's life. My heart goes out to you, it's hard enough to lose a child but lose her and then have to continue to live under a cloud of suspicion would be unbearable. Good luck to both of you.

I think that if the coroner ruled her death accidental, then the child protective agency should stay out of it. You didnt say, .... where are the other kids? How did the poor little girl die?? I wish that I could answer more, but I dont understand the circumstances completely. I wish your family luck with this. It sounds like a horrible experience.

Sweetie this is a very sad thing, the best that i can offer is for you to contact the child protection office and ask for a fair hearing.They will do an investigation and such including the home, and you and your husband.And if they determine that there is no evidence then they should rule in his favor and the kids should be returned to you all.If this is truly how they ruled and you have it in writing then use it to fight for your husband and the kids. I wish i knew more to offer but my heart goes out to you, good luck and best wishes.Fight for your rights!

If the death was ruled accidental, why did child protection take the kids away? If you don't have a lawyer, I would hire one immediately to assert your husband's parental rights.

I am sorry for your loss. You could go to court with children services and show them the corners report that says it was an accident. I hope you get your other children back. Good luck.

How did the kid get a tire in her throat and a BAG over her head??? That doesn't sound accidental...the tire maybe but not the bag. Maybe you should check into who was near her when it happened. Another kid maybe?

you cannot change thier minds and it is a waste of time to even try. cps is a legalalized child kidnapping organization. you have to take them to court. the judge cannot keep children away from parents without substantial proof of fowl play but cps can even though they should not be allowed to. sorry to hear about your situation....good luck
