A friend was arrested for something not drug related. However, when they were arrested, they had drugs in their system. Can the police charge them with anything after the fact?

did they do a drug test? take blood or urine? They COULD add the charge for the DA to consider, but they have to have some evidence to offer.

Did the officer do any testing for physical symptoms? or is your druggie FRIEND just drug paranoid?

If they didn't do any of those then your FRIEND (hopefully soon to be EX-friend) should count his/her blessings.

Yes, I work for a lawyer, and I've seen it happen more than once. As someone else said, it doesn't matter if the drug charges come after the fact, if the fact is that they were under the influence of an illegal substance at the time of the arrest.

Yes. It isn't after the fact because the person was on the drugs at the time of the arrest.

How were they able to obtain the specimen for testing if it was not drug related? Why would they have the subjects blood seized if there was no probable cause? I think there are a few things that were not told to you.... There should of been a search warrant issued to obtain ANY blood or urine evidence form the person in question. Unless they did a consent to have the sample taken.......I think your 'friend' has not told you the whole story....Hope that helps.

depends on what the crime was...if it was a accident of some then yes but if it was something dumb then no but if they get put on prob then they need to have the system clean at all times or they could do sometime. They won't arrest them again it will just add more charges to the one they already have

Yes they can. I was arrested for Drunk and disorderly and public intoxication and assault. After they arrested me they forced me to do a pee test and this dumb *** cop told me to pee in a cup while he watched. So I peed in a cup and the pee test came back positive for drugs so I got more charges. At least after the pee test i peed all over the floor of the station and the dumb coo had to clean up my pi-ss. You should have seen his face as I kept peeing on the floor in front of him.

If they tested them for drugs/alcohol at that time and the results come back positive.......yes. They can charge them.

Maybe commiting a crime while under the influence of said drug in their system
