If I claimed EIC honestly thinking that I qualified for it...will I still be penalized and if so, can they arrest me? Can I be charged with a criminal offense?

I have read some horror stories about the IRS arresting people and I am supposed to hear something from them this week. Can they just show up at my door??

If you claimed the EIC honestly believing that you qualified, then no, you wouldn't be arrested if it turned out that you were wrong. The EIC would be disallowed, so you wouldn't get it, and you might have to fill out some extra paperwork for a few years if you claimed it again, and if you'd had the money from it very long, you might have to pay some interest on it, but that's about it. You're not going to be charged with a criminal offense unless you were obviously trying to file fraudulently.

If you did something like claimed a friend's kids knowing that you weren't allowed to, you could be banned from taking the EIC for up to 10 years even if you did qualify in future years.

The IRS can not arrest people no matter what you've heard. They have no authority to do that. They'll send the creepy mail man after you though! No really, he'll just give you a letter that says how much you owe if you did your taxes wrong.

No, not directly. They have procedures to follow before anything like that could happen and it would be a last resort, and I doubt it would ever come to that.
