Probably... you should check with the state your 529 is located in. Is your child "classic" autistic or is this Asperger's Syndrome? Children with AS can do wonderfully in college if given the right environment. They may not do too well in courses such as literature interpretation, but may be able to learn some social skills in courses such as interpersonal communication.

Depending on the severity, you may want to consider setting up a Special Needs Trust so that they would qualify for Medicaid and SSI.

To the best of my knowledge, the should not be. I have a 529 plan for each of my girls, I used the one offered through my state. And I know that you can have funds released and not be penalized. Contact thedistributor of your 529 plan. If they have a website it should be easier to find the answer to your inquiry by checking the on their website. Good Luck.

Your refund would not be subject to penalty based on the child's disability. Contact your plan administrator if you want a refund.
