What happens after you violate probation does the PO violateyou? My brother has a court date for violating a one year probation period . He violated by pleading guilty to the same type of charge it was a cds possesion he was on Probation for and he violated for cds Manufacture/Distribute so what will happento him. Will he have to serve the whole one year in jail for violating because after the court date it is only one week left on the probation. And if he does what happens to the 3 years he had because by pleading guilty they gave him 3 years supervised probation which put him on 2 probations at the same time. He will not be able to do the supervised if he is in jail right. Can they put you on 2 probations at one time? I know it may be confusing but what are the possibilities. Please be serious he only has a public defender that's why I am asking. PLEASE HELP AND BE SERIOUS

I know it is a little confusing but he was on 1 year Probation already and violated it by pleading guilty to another drug charge and got 3 years probation so what happens when he goes to court for the violation of proabtion warrant will he have to do both probations or just the first probation and then when he comes home will he then do the 3 years probation.

Your post is a bit confusing. If I understand correct he had a week (court date) or so left of his prior years probation when he violated it. It is crazy to have a week left of probation and violate it. It looks bad but...generally if you violate probation you will at least have to serve out the remainder of whats left in your probation PLUS whatever you are charged with. In this case if he was sentenced already to 3 years probation for the second crime he committed he will go back before the judge again for the first probation violation. In this case obviously the judge wont be too pleased and will probably sentence jail time. The best thing for you to do is call his public defender and ask him to explain it all properly to you.

This q is a little confusing but from what I understand he violated by catching another charge? Well ppl violate all the time so at the worst, they will give him his backup time to serve, which Im guessing is 3 years, or maybe part of the sentence back. You do not do probation in jail, only after. So lets say he gets his 3 yrs back which is the worst case scenario, then he might do some probation afterwards but hope for the best!

If I understood your post correctly your brother not only has 2 drug charges but a probation violation as well. Your brother has already been given a chance to clean up his act and he has done nothing but prove he has not yet learned his lesson. Yes he can be put on more than one probation at a time but in this case it's not very likely. Your brother is most likely going to prison and he should. If it were up to me he'd spend the rest of his drugged out life there.

Your q is a little hard to understand at first, but they will more then likely send him to prison, yes they can give him more then one probation, extend what he is on and have to have more fines charges and costs for it.. But your brother has made a name for himself, probation is like getting a second chance or a third, I wouldnt go to court with him thinking he was coming home, cause it is more then likely not going to happen... And to be honest to you, you should kinda hope that he does go to jail/prison cause he is not doing what he is supposed to in the real world, maybe it will make him realise what he is doing wrong...And the public defenders, they are normal lawyers in most towns, the judge just has a list he has to go threw, so maybe he will get a good one that cares or one that dont...

they will probably extend his probation, he violated, so depending on his charges and if they convict him of a new crime, he'll serve time for the new crime and still be on probation, if he is founf not guilty he will more than likely expire in a week or for having police contact they may violate him and give him a few months, it depends also what state you live in.

They gave him a chance to clean up his act, and he didn't. He will probably spend the next 3 years behinds bars because of it.
Sounds like it was a 3 year suspended sentence with one year of supervised probation, so the sentence of 3 years will now be served.

yes you can be on two, three probatoins if the judge allows it.
But yes they can make him serve all of the orginal sentence but odds are he will only make the probation a tighter level on the first.
