You drop you children off at a local theater to watch a movie. Two men approach your child. The men ask your child a question and don't like the answer your child has given. The adult men begin physically assulting you teeanage child pushing, phunching in the face etc, and your child attempts to defend himself.
The police arrive after being called out. They take one man to jail for assult to a minor the other runs away. They give your child a ticket for fighting. It that justice?

I am sorry to say I am a little doubtfull that is the whole story.Not that you are a blatant liar like some people have claimed.I mean is your teenage child 19,Is he involved with a less than savory group of people( I think I just made that phrase up but i think you can understand it),did he make any slurs to them?I am not calling you a liar or your child but if I got jumped at the movies because i did something wrong I would be scared to tell my parents and might add or take things from the story to paint myself in a more favorable light.
But even so if this is your childs first offense and it was getting beat up by two grown men then the ticket is not nessasary.I think you should talk to a lawyer or something because tickets for fighting can be expensive (I know down here they are up in the 800 dollar range).So if your story is totaly true no the cops are not being fair.

When the officers arrived they try to listen too every thing and make a judgment call- No I am not a cop- But I have been arrested for fighting in the past they try to settle the situation, some times in the event of loud abusive young people still trying to get there point across. Possibly the officer was trying to make a point with the ticket, maybe your young person was still kicking the sh!t out of the person/persons when they arrived and had no choice, contact the officer his name is on the ticket, he will come over and explain himself.

The police respond and act upon information provided to them. If, when they arrive, they develop information to believe that the fight might have been mutual (in other words, all parties "threw down", so to speak), then they may well cite for fighting in public (or your state's equivalent violation).

All because one of the parties was older does NOT automatically make the older party guilty.

Consider also that simply because your son and his friends claimed it was "self defense" does not make it so.

If he goes to court, he can have his friends and witnesses testify on his behalf to say that he had to fight in order to protect himself. However, if that was NOT the case, then he may want to consider taking a plea if one is offered.

This is not likely a big deal. As a juvenile (if your son IS a juvenile) it will likely have very little impact on his future. Hopefully in the future he can avoid these fights.

No, the justice will be when everyone goes to court on the ticket and then justice will be served. Did the child have to fight? No, he could have run. Is fighting an offense that normally gets a ticket? Yes.

In the officer's defense, he wasn't there when the fight transpired. He has go to by what witnesses say (who don't always tell the truth nor entire story.) From there he has to make his judgement call. They ARE human and don't always make the correct calls. It's easy for us to criticize them. Cops, for the most part, aren't looked upon in a positive light.
If the teen's parents feels the cop made the wrong call, they have the option of fighting the ticket.

Your child probably said something offensive to set them off. The officer probably gave the child a lesson to learn.

I'm sure the cops that responded spoke to witnesses and got the WHOLE story Rick, not just the watered down, "I did nothing wrong" version that your kids told you.

No it's not fair, unfortunatley it's becoming more common. However you need to explain to your son to be more careful what he says to strangers, there are some real nut cases out there, they could have had guns and it could have been a worse outcome.

I bet there is more to the story...WHY did the just randomly assault you...doesn't sound right..and I AM a parent...I would look closer at my childs actions...and I do have a good kid...but....all kids get into scraps...talk to the cops...
