Tomato might be a vegetable in culinary sense, but scientifically it's a fruit. So are beans, eggplant, cucumber etc... They all are fruits because they are ripened ovaries of flowering plants. (that's the definition of fruit -in science: the ripen ovary of a flowering plant)
The term vegetable is a culinary term. It has no scientific value. How's your soup anyway? Tasty? Well enjoy.......

Technically, a fruit is anything that grows in the ovary of a flower. I tomato grows in the ovary of a flower. Therefore the tomato is considered a fruit.
