Unfortunately there is no guarantee that your ex won't get custody. Be positive, the chances of anything happening to you are slim. I used to worry about it when i first got divorced but i decided that life was too short to spend it worrying about something that was unlikely to happen

I am afraid that if his Father is alive and willing to take the child , and also has equal custody, then the Child will go to his Dad. You may want to go talk to a Lawyer and make your request, that if you should Die your Mom will get custody of your son. Do it ASAP so death does not cheat you out of a say so.

you have to state this in your will that you want your mum or sister to obtain shared custody of your son. However when you die your ex husband can contest the will and it will be up to the courts to decide whether it is in your sons best intrests to live sole custody with his father or shared as you have stated in your will with your mother or sister.

Make a will, now. Who's to say you wont get hit by a bus or something tomorrow. You need to be prepared for all possibilities.
Put it down, in black and white. Have it notarised or whatever lawyers do, to make it legal. This will ensure that your wishes are known.

He would probably go to his dad as he has equal rights. I reckon you'd probably have to go to court for that. You wouldn't have full say what would happen if you wrote it in your will. Unless there was somewhere in your will that the father could sign to agree that he would go to your side of the family. Maybe you should talk to your Solicitor?

I got around this by writing a will. You can buy a set and write it yourself pretty cheaply - then lodge it with your solicitor, making sure they witness it first!! Your wish would be considered paramount by any subsequent court case. It's given me peace of mind. Good luck x x x
