My daughter was born recent in new york, i was told, when signing up the birth certificate, that i should give the child my surname name because the father wasnt present (i am not married). I did this. The father isnt an american and doesnot reside in america. I now want to change my child's surname to her father's surname on the birth certificate....... his information will not be included on the birth certificate.......i am just using his surname. Will i need an acknowledgement of consent form from him? or can i just go ahead and make the change on my own? thanks for the replies.....Jada

You can legally change your child's name to anything you want, and since you're the only parent listed on the birth certificate you don't need anyone else to sign off on the name change. You just have to fill out a form, explain the reason for the name change (to keep criminals from changing their names to avoid prosecution), and pay a fee.

No consent needed for that but you might want to think of laws in other countries. Depending on where he lives If you ever take your baby to his country, then he may "own" the baby and you'll either have to stay with him to be with your baby, or leave your baby behind when you come back to the states. It's a big price to pay just to have his name on the birth certificate. If I were you....I would leave the birth certificate the way it is and enjoy my baby.

if the fathers details are not on the birth certificate then you do not need his consent. however, think carefully before changing your daughters name to her fathers as this may cause pain later in life. is the father ever coming back? if not, it maybe wiser to keep yours and your daughters surname the same and concentrate on your happy future together.

You dont need his consent to have his surname as your childs. His info does not need to be on the birth certificate either.

You only need his consent to have him listed as father on the birth certificate. Otherwise you can give your baby any first, middle, and last name you wish.

It isn't like Daddy has a trademark on his last name ;)

I don't know what the law is where you live, but here, in MN you can change the baby's name without anything from the father.
