It isn't always your fault, though 99.999% of the time the person who was rear-ended isn't at fault.
That being said, I was involved in a "front end/rear end" collision where the lady backed into my car at a red light.
Unless the other person admits to that, your usually at fault.

If you were rear ended, then the fault falls on the person that rear ended you, so swap insurance papers and wait for the police. I would also claim soft tissue damage in your neck and back. They can not prove it, but they can not disprove it either!

Get insurance information. Get license plate number. Call police....whoops..you are on a PC which means that it is probably too late. Call your insurance company and try to explain why you left the scene of an accident, didn't call the police and didn't get the identity, let alone insurance information, of the other driver....and listen to the adjuster laugh.

any time someone rear ended you,then its automatic their fault,because the police says you got to have your car under control at all times.at least thats the way it is here in pa.
