caused an accident by runnig a red light and caused injury to other passengers in another veh.....my question is how long did it take for you to get your claim...and did statefarm try the 3 d's with you DENY DELAY DISCREDIT! WHAT can one do do to get results....I already have a lawyer....is there some termonology I should be aware of to try to get this just done ....I have to go to a neurologist due to injury from this accident my insurrance has been through the ringer and so has our wallet in co-pays and to many days off from work ....from pain that I ca,nt explain that has fell back on me after nearly four months on being pain free........and we are expecting a child too!

i'M thanking this is just WITH statefarm since, my uncle had a case in 2003 and his attorney and the said insurrance company settled 8 months later .....his attorney demand letter presented cases similar to his cilents in montanna, my attorney demand letter did'nt any real suggestions and please no smarty pants comments only real reponses offerring real advice....I'm not dum....just that this is my frist and hope my last accident and the attorney is not answering my calls...@ 40% contingency fee ....can i drop him now and handel this myself....if so how and what will i owe him for abandoment by not talking to me about my own case!!!

fyi....i got treatment my doc told me i was not completly healed and that my body could relaspe antime and he put it in writting for the attorney!

i was transported from the accident to hospital stayed there 3 days .....and completed all my fllow up!

I would say you are looking at a little over two years for the full settlement.

I am assuming your lawyer is suing the other driver.

Any attempt to get money or information out of the insurance company without the request coming from your lawyer will yield poor results - this is true of all insurance companies.

The folks who like to settle their accident claims without lawyers all have something in common - small settlements. It will be a couple years in coming, and the lawyer will take a cut, but the lawyer brokered settlement will yield you hundreds or even thousands of times the amount the insurance company would have considered "fair".

BTW:40% is steep for the attorney - you could have done better if you had called several before you hired the one you have.

You only have so many accidents coming before the one that you don't walk away from, so grab the money when you can. It isn't like you asked to be in the accident.

I have had three accidents over the last 35 years. I tried to settle the first one on my own for $32 (The cost of the x-ray to tell me that I sustained a flex extension injury to my cervical spine) The insurance company (I think it was Liberty Mutual) didn't want to pay the $32. I hired an attorney and settled out of court for $100,000 + all expenses. My attorney charged 25%, but I got a check for $73,750 although it took a little over two years.

So Yes... It DID take longer because of the attorney. But $32 now versus $73,750 in two years... Let me think about it... Even with your thieving attorney's 40% it would have been around $60,000 - still a nice wadd-o-cash.

ah, of course. blame it on the company. Have you ever thought how much you are delaying this by getting an attorney? You would likely have been done MONTHS earlier otherwise.

Do you even know how attorneys work? They send letters to the insurance companies demanding hundreds of thousands of more dollars then they know they can get.. they play games and take as long as possible b/c they dont care about getting money for you and getting it fast.. they care about making money for themselves in the long run.

So, maybe you should have thought about that because now you cant even call state farm to ask them what is going on because you have an attorney. Why dont you ask your attorney what is taking so long?

Since you have retained an attorney, you may be looking at years. If you have any questions, don't ask here, ask your attorney.

Your insurance and State Farm should have been able to negotiate and get you a fair settlement. As soon as you decided to hire an attorney, that stopped that sequence of events and basically slowed the process.

You are totally screwed -- because you have a lawyer involved this could go on for ages. State Farm typically handles and settles claims very quickly and fairly but once a lawyer steps into the picture then everything grinds to a halt. By law, the insurance company isn't allowed to even speak to you and must wait for your scum lawyer to get off his/her dead a** to get anything done. Their tactic is to delay closing the claim for as long as possible so it appears they are earning the 40% they will take from your settlement cost. You can count on one thing -- your lawyer only, 100% of the time, works for his/herself -- NOT you.
You have my sympathy.

Welcome to the insurance industries world! You haven't been singled out by State Farm, they're all a bunch of crooks and our politicians are right smack in the middle of it all filling their pockets with "gifts" in exchange for political favors!
You have an attorney representing you so he/she should have the answers! Believe me, you are looking at probably three years for any kind of settlement!
I agree with the other folks that the attorney is in it for him/her self and not you! They all advertise on TV they go after those "insurance companies" and make them pay! Well, guess what, they are so full of sh!t it isn't funny!
Attorneys only take cases that the insurance companies will "PAY"! They don't take anything they have to "work for"!
So yes, the attorney probably is the contributing factor!

You can fire your attorney if you'd like, but they have a lien over any settlement you get. Should have thought about THAT before you ran off & hired some joker.

Sounds like you had a delay in both treatment & notifiying anyone of your injuries. This is very bad and does in fact work against you....why? Because when you're hurt you're hurt...you don't wait to get treatment. Delays of any sort are very suspicious and YES your bi claim can be denied because of it.

when i had my accident(someone ran red light and cleaned me up) it took 3 and half years to claim. the state tried to discredit me and they do try hard. make sure you include loss of wages(must prove), there arent conflicting injuries from other accidents, allow the lawers cost in the settlement claim. the have a tendancy to drag it out as long as possible so you get fed up with it and take what ever they offer.dont do this they hurt you fin. i know they did it to me.
