A break in by kids, ended up in us being the suspects because of what they said to police, they got a warrant found some herb and took my husband hunting guns but never pressed charges on any of the 6 involved, it has been 5 months and no charges brought forth yet on us, the officials from town (we live out of town) continue to drive by 2 and 3 times a day, we feel that we are being taunted . How log do they have to bring forth charges and when will they release our property. Some one violated our privacy and we get the charges, unbelievable.

A warrant is issued by a judge so there was some validity to the complaint of illegal activity in your home or the judge simply wont honor it for the police. You are unclear if the kids broke into your home, and reported the drugs or another home where you are all suspects. What a mess.
Once the warrant is issued the officers generally can seize firearms, especially if they find marijuana as well.
Guns, break ins and drugs don't mix and greatly concerns me. When police see a residence where the people living there are involved in illegal activity, had drugs and guns they would not be doing their job if they didn't watch the house. What you are indicating is the police are doing their job. If your neighbor was known to have guns and drugs would you let your kids play over there or would you watch them, the neighbor and be concerned?
Once the guns are seized in most states you need an order from a judge to get them back. Under these circumstances many judges will not return the firearms.
Depending on the charges the statute of limitations to charge you can be at least a year or more depending on the crime. They may be gaining evidence or additional fact to prepare a charge.
I would walk the straight line from now on for sure!!

Great answer by madderthanthehatter. My advice also is to contact an attorney. It sounds like you and the suspects were in the wrong. There is a statute of limitations that governs how long law enforcement has to file formal charges.
An atty. can cut to the chase and find out for you exactly what is going on.
The reason the officers drive by your house is that you have been identified as a drug offender. You describe it as "some herb"...but if it was a misdemeanor amount you wouldn't be catching this amount of attention. They're not taunting you (why would they?)...they're watching your premises for additional signs of drug traffic. I'm sorry that you got burglarized, and the kids should be held responsible. But you brought the drug problem on yourself.

The charges are not brought by the police they are filed. Once the charge hits the DA's office they can hold it until the statute of limitations expires on the particular crime. Anything held or associated with the case is in limbo until an indictment is brought. Call the DA's office to find out the status.
As far as the cops regularly going by your house, it's called patrolling. We tend to stick around folks we believe to be criminals to catch them doing something else. If you call and complain the cops would most likely get a "keep up the good work" speech.

They have till the statue of limitation of that crime ( sorry but don't know the state or the exact law or crime ) but that can be 1 to 3 years to press charges depending on crime and location.
And just driving by is not harassment, and they can do it as long as they want, that can't be stoped.
You will need to make application to get your goods returned, although if they found drugs on the property, they may not have to return the guns, even if charges are not filed.

As for being able to file charges over the robbery or the weed, both of those boats have sailed.
They can come around as much as they want as long as they don't speak to you or come on your property. What they are doing looking to see if you sell, and the weed has given them probable cause. They are checking to see if you sell and are looking to see if you have visitors who seem to stay for only a minute or two. If you do have short term visitors and with the weed, they can get another warrent.
So my advice is to abandon smoking weed or anything else illegal because you have gathered their attention. When they see nothing else going on and no regular visitors, they will go away.

Well depending on your state firearm laws you will probably not get your weapons back ,due to the drugs found on the premises the firearms license will most likely be revoked for life.On the kids not getting charges?That doesn't sound right,probably one of their parents has tight ties to your local government.
