As long as the vehicle has never been titled, it is considered a new car. Dealers use new cars as Demo's, or test drive vehicles etc, and they don't need to be titled. So they are still considered new. If they still have the MSO or MCO (Manufacturers Statement/Certificate of Origin) it is NEW. The vehicle can actually be a 2005 and still be considered new if never titled. Most dealers if using cars as Demo's etc., have their own mileage rules. They may take it out of Demo service if it has 10,000 miles or 5000 miles, depends on the dealer. Some dealers offer Demo's at a discount, others don't. Basically mileage doesn't matter, it is whether it has been titled that makes the vehicle New or Used.

If a car is owned and driven by someone other than a dealer it can't be resold as new. If the dealership has the car and it has test driven miles on it, it still can be sold as new. When you buy a new car with mileage on it, the dealer will exempt those miles from your usage. If a car has say more than 100 miles of people test driving, then the dealer may sell it as new but for a lower price.

Elaine is correct~
It can be on the car lot with 5,000 miles on it and considered "new" (if it's only been used for "test" drives for example).
But, once you purchase the car and drive it off the lot, out of the driveway and onto the street, it is now a "used" (ok, "like new") one-owner car.

A new car is one that was not registered, once its registered it is no longer new in the legal sense, in terms of how long it will feel new, usually about a year when the next years models come out.

It is considered used as soon as it leaves the lot .then it becomes ,Like new .once it has an owner :(
