If that injury is caused by someone then yes, it would be grounds for battery or assault.

It depends how you got the injury. If you simply fell down on your own or had some form of accident obviously no. But if someone even touches you...against your will...even if there is no injury it can be a crime of battery. Even a threat can be considered an assault without even receiving an injury. For example if someone holds up a knife and says I am going to stab you. That is a crime. The more serious the injury or threat..the more serious the crime will be.

It depends, how did the injury occur.....it would be assault 3 if it wer in a fight...depending on the rest of the story.
