I filed a police report in September of 06 that is badly needed for an impending lawsuit against a major corporation. I don't know how effective it would be to have it seeing as I have numerous witnesses who seen the incident and the person this is against is on his own as he didn't have anyone with him like he should have. My attorney requested a copy of the police report which was filed soon after the incident and now upon trying to retrieve a copy of the police report they are saying they are unable to locate it for whatever reason. Now what I need to know is even though I don't know how useful this police report will be, I would still like to have one as a just in case and also because my attorney has requested one. How do I go about obtaining one? I have heard that in a case like this where the police report can't be found that they will just issue a new one. Any help on this would be great. By the way I'm from West Virginia as I know that different states have different laws

The police report is vital and will certainly help you in your case. The fact that the report can not be found can actually hinder your case. For example the opposing counsel can claim you were dishonest and never filed a report as you had indicated. I would hope the officer in question gave you a case or report number. If you have that it will save the day. Most agencies have computer records backing up the case report. For example if dispatch records show that on that date and time and officer was at your house handling a call that would show that you attempted to file a report. An agency always has at least those records. If you have this I would get with a supervisor and request the report be written again and indicate the circumstances of how it was lost etc.
If the agency says they have no record of this call, report or contacts from you then you would have a problem. The agency can do a report but they will indicate you came into the station CLAIMING you filed a report many months back but there is no record of that. Now your credibility may come into question. Also there is a possibility the officer chose not to write a report on the matter. Many agencies only do reports for CRIMINAL violations and he may have determined it did not warrant documentation and did what is called a NO REPORT for the call.
