I have a small balance at my daughters daycare and they will not release my tax statement until I've paid it, which I have, but was wondering if they can do that.

They can threaten, but I think federal law requires them to provide statements under penalty. Of course, if the unpaid balance is shown as paid on the tax statement, they are required to amend the tax statement. It would be easier to wait to make the amendment until the last day that they have for issuing it. This way, they can say they are not with holding the statement if asked by the feds.

That stinks. No, they can't do that but you can get around it.

You do not need the statement to figure your dependent care credit. Did you get a statement last year? That has the EIN on it. You already know what you paid.

If you do not have the EIN, many tax prep places have lists of all the daycare EINs in their areas, since there are clients who have expenses at those places but do not have the statement.

So I'd just get the EIN from a tax prep place or a friend of yours that did get a statement and do my taxes without the statement.

Let them know that it's OK, don't give me the statement, I'll just report you to the IRS after the filing season closes.
