I was in a car accident (12/26/06 at no fault of mine) and was found to be injured two and a half weeks later. I have whiplash (X-rays show that, and neuro says strecthed neck muscles, muscle spasms, and inflamed occipital nerve casusing headaches, due to accident) and have been dealing with 7 weeks on constant headaches, neck/back pain, and nerve pain. Multiple pain meds and doctor's visits have failed. CT scan fine. I am seeing a chiropractor and neurologist. I start with physical therapy next week so I hope that works. I will be looking into a lawyer soon. I already notified my medical insurance to warn about lots of medical expenses & they had me contact their subrogation dept. Where they go after the third party insurance company for the money. Am I still entitled to see a lawyer? Is anyone familiar with this process? The pain has been horrible and has turned my life upside down. I am not looking to be rich by any means, but this isn't a quick fix and I could suffer for awhile.

I'm not sure what you mean when you say you were "found to be injured two and half weeks later," you either are or are not hurt. But to answer your question.....

2 separate issues, but the lawyer will play games with your bills. For example...your doctors bill is $200, but your doctor accepts the insurance payment of $75 by way of their agreement for the office visit. The lawyer will attempt to recover the full $200, even though that's not what was paid, and pocket the difference of $125...money he's not entitled to, money you're not entitled to, money the doctor isn't entitled to. The bill is $75, not $200. And people wonder why insurance is so expensive. You may not be looking to get rich, but I guarantee the lawyer is.

Depending on the type of health plan you have, they most likely will have a lien against any settlement from the 3rd party and if you get a lawyer, make darn sure that lien is satisfied.

As for your pain.....any doctor will tell you soft tissue injuries resolve on their own within 6 - 8 weeks without any treatment, taking ibuprofen and using heating pads/ice packs and taking it easy. If you're receiving treatment (which normally consists of the above at a chiro's office) and you're not experiencing any relief, you should switch doctors.

Each Generation is getting worse. Kids are misbehaving more. Gangs are growing. Drugs on the street are being sold by children just entering their teen years now. I have seen plenty of cases where parents could not control their 13 year old children and they have been sent off to juvenile hall. Kids are become more abusive towards everyone they encounter if they do not see eye to eye with someone. Being the fact that you're in your a female teacher you will be harrased by students sexually verbally and in some cases physically. Parents are teaching their children respect no more. Also parents are so afraid of Social Services, that they are too afraid of a little discipline. Children are only as bad as the parents just like having a pet if you dont teach it manners it won't have any. I my girlfriends boss has a 11 yr old daughter to uses volgar words, drugs (coke. marijuana) and always into trouble. fights break ins etc. Mother didn't know what to do with her, tried canceling nothing worked and now the girl is sitting at a juvenille detention center until shes 18. Becareful what you say to your students but dont be afraid to try and teach them some manners. The nicest teachers have the best chances to succeed without fear! Some people say move. I say dont gvie up! I would rather go to jail for giving my children discipline then them to grow up in a life of crime!

Depending upon the state you have a certain amount of time to file a claim. Each state may be different. A word of advice, do not talk to your insurance company without consulting with a lawyer. If your doc says it is likely you will suffer for a long term or forever, then you should most definately see a lawyer, you can recover more than just your med bills, do not call up one of those injury attys you see on TV all day long, they will get you short changed in the end , do your research, and get references. make sure the atty will work for you.

I don't know much about it bit I do know that you have a right to consult with your own lawyer to look out for your rights.
