My brother is overseas serving in the Military in Turkey and the woaman he is seeing is pregnant. If they are able to have the baby here in the U.S. how does citizenship work for the baby and what rights would my brother have if she does not want to stay? Is it harder to take the baby to where she is from or can she just up and leave and take the baby? Any help would be greatly appreciated. (Serious replies only)

she can't just show up to the States to have the baby. she must come over here legally.. through proper channels. being pregnant isn't enough.

easiest way would be througha Fiance Visa, but oif she doesn't get married, then it will be revoked and she will have to leave, and yes, she can take the child with her unless he gets full custody, which I doubt he will get.

If she has the child in Turkey, than he might be able to establish American citizenship for the baby through the birth certificate. but Turkish law applies here for purposes of custody.

Your question is so confusing. It sounds like you are this woman.
If the woman is pregnant already, and they did not apply for a fiancee or a spouse visa, it's most probable that she will have that baby in Turkey.
Then he should either apply for a fiancee visa and bring her to States and marry her, or marry her in Turkey and apply for a spouse visa for her. She can't just go to the States unmarried. If she comes to States and ditches him, she will be sent back to Turkey. She will be allowed to take the baby with her, or, if she wants, to leave it with the baby's father.
Regardless of where the baby is born, this baby is an American citizen by birth. If the baby is born in Turkey, they should register it with the US embassy there.

If she visits the US and the baby is born during her visit, the baby is an automatic citizen (illegals coming across the Mexican border do this and they are called anchor babies) they are not going to deport the baby as it is a citizen and the baby's mother will not be deported as her child is a citizen, hence the term anchor baby. If she has the baby in Turkey then she has no rights to move to the US. The baby does though as it is a child of a US citizen (this only applies if he is the father). Even if it is his child he needs to go through the US consulate and loads of paperwork to get the child into the country. If he wants to marry her and move to the US he needs to research fiancee visas.
