I used a 'buy it now' option on eBay to purchase a new battery for my camcorder. As I alwas do, immediatly after I won the purchase I paid for it via paypal.

2 days after that I got an email from the seller that he 'just' checked his stock and it's not in right now, then he said I'll have to wait like 8 business days until he gets it in, and THEN he'll ship it out to me.

Is it wrong to sell things, that you don't currently have, on eBay, expecially since it didn't mention anything about having to wait for new stock on the product description?

yes. you bought it with the information that it will be shipped as soon as payment was received. they didnt do that. i am sure you will get your battery but they should give you some sort of discount for the inconveniance. i have sold things on ebay and i always have the item. but there are bad seeds, i bought a season of the sopranos once and never got it. its best to check feedback. hopefully this was a one time thing and wont happen to you again. good luck

I agree that it's not correct to sell something that you don't have! You have to post it once it's on your hands, at this time I would recommend you to ask for a refund.

When buying from ebay always try to look for the profile of the seller by the feedback score ( try to buy from seller with 90% or more), the quantity of feedback he has (over 500 in the past 6 months means he has much activity) the look of the auction (perhaps it's just a copy/paste auction or very simple description with no detail) and the items he has for sale.

The combination of this factors tells you how the seller will respond to a sell and how much committed he is to deliver the product. If you have doubts about whether the product is in stock don't hesitate to contact him and ask a specific question about the item, if he doesn't answer I recommend not to complete the purchase.

We had the same thing happen. My husband bought something, actually as a gift for someone, and the guy got paid immediately, and after about a week we got an email saying it currently was not in stock, and we'd receive it in 3-6 weeks.

I think ebay should put a ban on businesses selling something they don't have available for shipping immediately, or the business or person should have to put a disclaimer on their page that you can buy it, but it **could** be on backorder.

report them through the ebay process. I seem to see that a lot. The link should be under the "report a problem"
Unfortunately they might make you wait for a period of time before you can report it. The issue with negative feedback is that they can do it right back to you. And most big sellers on ebay don't care. Be lucky you will have it at all. Sorry you have to go through the B.S. of some of the BAD ebay sellers out there. All in all, my experience on ebay is very good.

Tell eBay about the situation (but not report him), and wait. If he does give you your battery, give him a low, but fair rating (for example: Did not have product on hand when payment was offered, extremely slow service, etc. etc., and not F-U MOFO Go to hell). If he does not contact you within a few days to tell you how things are going, report him to eBay. Hope this helps!

Yes. File a complaint with paypal AND eBay and get your money back. People shouldn't sell things they don't have and get YOUR money. He's probably trying to scam you. I'd open a complaint.
