have answered this question before but I got a violation for using the word fagg instead of cigarette. You don't get a fine for smoking a CIGARETTE at the wheel as the government get a tax off cigarette's but they do not get a revenue off the mobile phone use. Not much anyway so they are better off if they fine you for the use of the phone as the fine goes to them as does the increase on the insurance premium tax (some insecure fagot must have been thinking I was insulting gays well I do that in society and culture thankyou) so how was this answer insulting to gays apart from of course the content of the parenthesis, brackets before you ask.

well if you are in the UK look in the Mail today. A chap was fined for eating a sandwich while driving and it says there that smoking whilst driving can also be classed as an offence. It comes under the same law that says you can't use a mobile phone as you do not have full control over your car. Hope that helps.

Mobiles are more of a distraction, as from 1st july 07, smoking in a company car/van will be illegal, with a £30 fixed penalty. same applies to enclosed public buildings

In the right place at the right time, I smoke, eat sandwiches, eat sweets, listen to the radio, drink coffee, use the hands-free mobile and the two way radio.
I expect it's all illegal in England, like most things.
Unlike the Irish truck-driver I met, I haven't yet worked out a safe way of cooking bacon & eggs on the move.

I was being given a ticket a few weeks ago & the young copper said ow I see you are smoking a cigar too & was going to book me for that as well. I convinced him I had lit it on my way out of the car though.
When the smoking in public places law comes into force it will be then illegal as your car is classed as a public place. This was proved a few years ago when a guy had a pitbull terrier in his car with no muzzle on. he was done for having his pitbull un muzzled in a public place!! crazy world we live in or what ???

There's a woman who got fined for eating toast in her car whilst driving. I reckon after the "Smoking in public places" law comes in the only two places I can smoke with impunity are my house and my car so I say "Hippies, go hug a tree, your environmental cred got a caning on C4 the other night, don't give me a difficult time". ps I'm aiming for the most downthumbs record, currently 19.

No, not yet! However the law, as always, is an ***. Todays papers show a fella getting a £60 fine and 3 points for eating a sandwich whilst driving. This counts as driving without care and attention.
Smoking at the wheel......................of course it should come into the same category?

They can't fine you for smoking when driving, but I think it can be really distracting and dangerous. They can actually fine you if you flick a cigerette but out the window, as its classed as littering! (I saw a real life documentary where a lady was fined for doing it!).

I did smoke and drive for many years. I don't smoke for quite some time anymore. Smoking is nowhere near cell phones in terms of distracting drivers, and I don't see any reason why smokers should get fined.

While it is silly it is nothing like as distracting as chatting away on a mobile. I've had lots of near misses with mobile users with their heads in "dark places", but none with smokers. However, I wouldn't smoke while driving.
