i live in the United Kindgom n 2day a police man stopped me in car for supposedly using my mobile fone altho it was in my pocket all the time n no calls made. i did have my hand on ear so understand how looks it. now as a result ive been given a f**k** fixed fine n 3 points (1st evr too!). the problem is i have another fone and it WAS used by a family member durin the offence time.

im thinkin abt takin to court and sayin i didnt use my fone cos as he noted its mobile numb. n IMEI no. the network will show no calls made as i DIDNT USE IT! but i want to find out can the police find out tht i have another mobile cos then they'll say i used tht 1 wen instead wen i didnt????

i showed the fone i had with me n did show the history n showed nothing come up. was first time for sumit like tht , jst paniced n felt intimdated and jst thought fine say yes knwing can contest....but dnt 4get tht mob i had n tht he noted will not show any calls as none made.

If you are running pay as you go and haven't bothered to register it, it is untraceable, but as i bought one last week the shop insisted on firing it up and registering before I took it away!
Is this the thought police making sure that the number of unregistered phones is reduced? i put my old sim in it anyway so now it's a different number and the registered sim won't be used!

They would not do that much enquiry into something so trivial. It would be a waste of their time. Get a solicitor, and explain the situation to him or her. If the cop noted the number of the phone you had in the car, then they must prove it was THAT phone that was used; having another contract is irrelevant. Your solicitor can lead the call record of the phone as evidence in your defence, and if they even do find your other contract, the solicitor can have the person using that phone at the time to provide a statement in your defence. But seriously, all you need to do is introduce a reasonable doubt into the mind of the judge that you were not using the phone, and the call record (usually available in hard copy from your network provider) should be admissable as evidence.

I the other phone was used in another Cell they will be able to tell. Besides your phone registers incomming and outgoing calls........so whats the problem?
