I was working in Raleigh, NC. The company has less than 15 employees so EEOC can't help me. I am a single mom with 2 kids and my elderly mother lives with me and they depend on me for income. I am still sick 2 weeks after quitting. Who can help?

IF it is not illegal to smoke in the office in your state, there is not much you can do other than writing a letter to the home office. Assuming there is one.

Good luck

You would have to be able to prove beyond a reasonable doubt that their cigarette smoking around you alone is what has caused you to fall ill which would be almost impossible. I would say to make sure to find a smoke free workplace from now on. As hard as it makes it for others, everyone has rights and the right to smoke cigarettes in a place the law does not forbid them is one of them. As far as legal action i couldn't possibly see anything happening there mainly because since they weren't breaking any state laws by it, you would actually be the one responsible by not removing your self from the situation.

I have to assume that you are now either drawing unemployment benefits or looking for another job or perhaps both. In the future, during the job interview, be sure to ask what the company policy is in regards to smoking. If the company you are interviewing for allows smoking, simply look elsewhere for employment. If they do not it will probably be a plus for you when they are looking to hire.

I would look into the family/medical leave act. Then I would try to hire an attorney for discrimination. I hope that you can find another job-but try an attorney, maybe he can help you. Good luck.
