I have asthma and am allergic to ciagarette smoke. I live in an apartment complex and the family that moved in next to me smokes in their home (regardless of the fact that they have three small children). Since our ovens share a wall the smoke gets into my apartmet, which causes me to have frequent asthma attacks. I've talked to the landlord and she told me to get air fresheners. Do I have any rights to a healthy living environment? What can I do about this?

I can't close the vent to the oven, and air fresheners only mask the scent, the smoke is still in the air, and will still cause an asthma attack.

I heard on the news about some smokers that had to go across the street to smoke because of a similar situation! It was somewhere in the US, and I know laws can be different in every state. I'd try calling around...try city level first, then county. Good luck, you might have 'a leg to stand on.' Even the local news?

You need to bring the apartment manager over to your unit when the neighbors are smoking. It sounds like their fan over their oven is venting into your apartment. If this is the case, your landlord either needs to fix the situation so smoke vents properly, or you have an action that would allow you to vacate the apartment without penalty. If he won't fix it, document with video/photos and move. If he comes after you for breaking the lease, you just pull out the video/photos and show how bad it is. Something else to consider, it may not be cigarette smoke. It may be fumes from cooking that are venting into your apartment. Whatever it is, the landlord needs to correct it or you have every right to move without penalty. Good luck.

How can your ovens sharing a wall allow smoke into your apartment? Frankly that doesn't even sound right.

As much as you have the right to have a healthy living environment they have the right to smoke in their home as well. If your landlord told you to get air fresheners....well, maybe moving to a "non-smoking" complex would be the best permanent solution for you. Or, maybe you should look into the possibility of buying your own home....you really don't need a lot of money to purchase a home with FHA.

you should try to get a diffirent apartment since the landlord dont do nothing about it or just put them wall air fresheners and put them inside your house

there is not much you can do about that..you could open your window when you smell the smoke..if you have ashma that bad you could find an apartment that rents only to none smokers ,.thats an idea..other than that get some febreeze and spray it also...good luck
