3 years ago I had intercourse with a stipper named Jasmine. We discussed STD's in depth and if either of us had them. Two months later I went for some testing and was diagnosed with Hepatitis B. Come to find out she had it and I think she knew in advance she had it cause she never acted surprised by the results of the test or should no worried of the possibility of having the condition. The point is do I have a legal case?

Probably not much of a case. First, you would have to PROVE that she new that she was infected and also that she knew that it was contagious. She would probably would of had to admit this to someone that would be willing to testify to substantiate this. Next, even if you were able to prove it, you would have to show significant and permanent damages to you health. Lastly, she would have to have the financial capability to pay you damages, unless she is insured, it's unlikely that you would get much.

Depending on your state, you may have legal recourse if you can prove that she knew beforehand. The difficult part would be obtaining her medical records as this is confidential information.

If you can prove that she had it and was aware of it and then not only went through with it, but denied having it.
