The ways the std is passed onto another person is when there is a sore in that area, if there are no sores it is pretty hard to spread herpes.
The way a person knows they are getting them is they would feel like a tingle on an area of the skin

the herpes virus can be shed even when someone does not have an outbreak. in that case no one even has a clue it's happening. a sore is an obvious indicator, but most people also get a prodrome of tingling/burning sensation in the spot where the sore it going to come. they are contageous at that time as well as when they get the sore. contact is all you need to get the virus, condoms can help, if the sore is on the penis. however if it's somewhere else like on the scrotum then there may be little that you can do to avoid contact.
i don't know the actual amount of risk for transmission... some people only have a couple of outbreaks in their entire life. you need to decide if it's worth the risk... then you should use condoms if you do decide (condoms for oral sex too and you can get genital herpes passed into your mouth/oral area)

As far as I'm aware it is passed by someone with a coldsore (or genital herpes) making contact with the skin of another person. I think as longas you used protection when he had an outbreak it would be ok. You should probably look up herpes in google though to get a full picture.

Like any other STD, bodily fluid is the vector, and your friend doesn't even need to be symptomatic to infect you. Don't sweat it, oral herpes (cold sores) are about as common as the common cold, an estimated 95% of humanity usually gets exposed sometime in their lives.

Herpes can be active even without having symptoms and lesion on the skin. Even using condom, it can't really prevent from infecting because the area where the condom can't reached but the skin can contact to skin, you can get infected.
