Good luck but even if yo have a witness to prove it didn't happen, the court would believe the police report.

Didn't you know that cops are God? Everything they say, do or write in a report is perfect. They never make mistakes.

Sorry "The Go To Guy" but this is how cops act. For example, we made a LEGAL u-turn and a cop said that we made the turn in the wrong spot - too close to the top of a small hill. We had proof that he was wrong but the judge took the word of the cop and the ticket stood. The cop LIED and the judge believed him!

You need witnesses or evidence to disprove the report. Mere speculation won't do it. Come up with facts, etc. especiallyl for the insurance companies.
When it is all said and done all cops do is write the report, we don't decide who pays or who doesn't. I could write you were guilty and the companies discuss the facts and disagree, and find the other person negligent.
Since cops aren't perfect (I know this for sure from reading all the cop hating questions and answers here), the insurance companies still work to hash out who has to pay in an accident.
