I personally would laugh this case out of the court, and your insurance company should be able to mount a credible defense on your husband's behalf. Let your insurance company handle this.
Check if your state has "good samaritan" laws, that basically says that any one TRYING to help a victim is immune from lawsuits.
Did your husband call 911 after the gun battle? Does he know where he's going or is he trying to get out of the area? You should have plenty of police reports if it's a random shooting leading to car crash.
These are all questions your insurance company and/or their lawyer will ask you. Again, let your insurance company handle it. They will know what to do.

First, I'm sorry this is happening to you. Second, the unfortunate thing is it does happen for a variety of reasons.
IN MY PROFESSIONAL OPINION, your husband is not responsible for this. You should speak with your insurance company...many states have a "Good Samitaran" defense which prohibits these types of lawsuits from coming to light and an argument can be made your husband was a "good samitaran."
Your insurance company will have their attorneys contact you repeatedly regarding this case. But here's something you need to know....many lawsuits settle on the courthouse steps. If your insurance company pays them, they are doing so NOT because they think your husband is at fault, NOT because they think the other party is entitled to the money, but because they are doing so in YOUR best interests. But as I said, talk with your insurance company & the attorneys...they will keep you aprised of the status & their legal strategy.
Bottom line...they're looking for money, they're looking to blame someone, and you were picked.

Well you can try any theory of negligence you want when it comes to lawsuits. Since he was in your husband's vehicle when this happened it's not surprising that a wrongful death suit was brought. Without that insurance policy no one gets compensated for him getting shot and dying, right? But now there are some deeper pockets for them to seek payment from. I guess we can all learn a lesson from this, can't we?
Not sure what will happen with the illegal alien status of the parents, but as long as your insurance knows and is handling your defense they can deal with that too.

Not a leg to stand on. Your husband obviously didn't have anything to do with his heart attack. Just some asswipes that are sue happy. Most insurance companies have very good lawyers.

i would not worried about it, for in the end, they going to get nothing, first he was trying to help, 2th he he was,in a wreak, it was cause he was doing his best to get the boy help, he did all that was he could do, so ,dont worried
