They were married in Dec 2005 and she received her permanent residency in July 2006. Found out that her husband is a crazy one, likes to take her money out from her bank and always yell at her if she doesn't do what she was told. The question is, if she decide to leave him; what would happen to her paper? can he remove her status?

If she married in Dec. 2005, by July 2006 she must have received the TEMPORARY residency valid for 2 years from the date it was issued. If they divorce during those 2 years, she will have to go back to her country and forget about the USA.
He will not remove her status, but he can withdrawn the petition he filed for her.

She probably has the option to divorce him and argue that she is mistreated. & come on you never get to know people very well-one can never be sure we are marrying the right person. I know there is a special program/protection for women that are mistreated, but I cant remember the name of it. The best thing to do is to get professional help-immigration lawyer- and let him know that she is being mistreated. She should not stay with him only because of the fear of loosing her legal status.

If she divorced him she will not be able to re-new her permanent residency. Right now she has a 2-year conditional greencard which she has to renew in by 2008. At that time, she has to prove to INS that she is still married. She has to show joint tax returns and prove that they live in the same address, etc... If she can't prove that they're married, she won't get her papers renewed. She's in a tough situation. I wish her luck.

If she's already recieved her residency then I doubt it. But to be on the safe side get her to document everything horrible thing he does to her.

And if possible that she has a witness to his insaness its even better. It would also be a good idea to contact a lawyer that is informed in immigration law and divorce law

if they have been married less than three years, he will not remove her status, the government will. She will no longer be a citizen of the US and will most likely have to go back to her original country. She should have thought about marrying someone before she married him. Sorry for your friend.

She should have gotten to know him before marrying him, but besides that, I think he could file fraud if he suspects that she married him for her papers. But not foresure, she may need to contact a lawyer or call immigration directly and ask them, she does not have to say who she is just that she has a question....

Isn't her permanent residency conditional for 2 years? If so, then yes, it can be a problem. I don't know the details, though.

would it not be eazy for her to go to another bank and open another account and leave her husband off the acount
