My ex boyfriend and i
dated for about a month
I found out i was pregnant
and the way it added up
it turned out to be my ex boyfriends
which i was still in love with
and he was still in love with me
so we worked it out
and still together now and happy
but a month later my ex decides
he wants his things back, and thier not his
thier mine, he bought me an ipod for christmas
and he also bought me a phone
out of kindness because mine had broke.
he got it under his name, and i dont
know why i let him do that, but i did.
well after we broke up, he turned the phone off
the phone got turned back on in my name
So the phone is under my name
and the ipod he bought me is in my house
he is up at my work harrassing me for it
and i want to file a report or something
or get a restraining order if this continues
hes saying hes going to call the cops
what do you think the cops will sayhe has the paper work but these were all gifts over a month ago if he takes me to court

If he takes you to court, your attorney fees will be more expensive than an Ipod or a cell phone; including the cell phone fee for early cancellation.

I'd just give him his stuff back and be done with it.

Perhaps the love of your life will buy you an Ipod and a cell phone. Their just material things, your feelings are more important than that.

you need to get all proof that you can possibly find that the things he gave you were considered to be gifts. if he didn't state that he ever wanted them back, or to be repaid for the cost, then it is a gift. turning the phone off is technically allowable since on a month to month basis he can determine whether he wants it or not, so to keep that you may have to pay him for the cost of the phone if you go to court. but he should have at least given you a warning that he was going to do it so a judge could possibly rule that you do not have to pay due to this inconvenience. as far as the harassment goes, he should not be harassing you, especially at your place of employment. once again it helps to have evidence such as a witness. if it's just your word against his you have a smaller chance of getting a restraining order or even just getting him to leave you alone.

As far as I know the law, at least here in Florida, he will have to take you to court. The property is a civil dispute. From what I have witnessed and heard from people who have been in similar circumstances, if he gave the items to you as a gift, then they are yours and he has no claim to them. I would be more concerned about the baby, he could file for custody, and could be awarded it, at least joint custody or partial custody. That is the fight I would be more worried about. I don't think he would waste the money going after a few items that cost about as much as filing a civil suit & paying court cost for.

The little Indian Giver! I don't know what the judge will say, but I think that it would be a lot more trouble than it's worth to go to court for an iPod and a cell.

You can't take back gifts. The ipod was definitely a gift but
the phone is a little iffy. But just a little.

A gift is a Gift,it is yours.Get a restraining order he is harassing you at your work place.Which can jeopardize you position there.
