Someone was telling me that if you are a passenger in the car of a driver who has their license suspended (and you have a license) that you could get in your license taken away due to letting the person drive. Is this true? This is in California.

i live in illinois and this has happened to me twice (with the same person go figure) the first time he was driving my car with a suspended license and even though my license was valid and i had insurance my car was towed and impounded but i didn't get in trouble, i was out 800 clams tho to get my ride back, the second time we were in his car and he was driving and got pulled over the cop ran my license (it was valid) and let me drive the car home (my buddy was let go with a ticket)..could be different in CA but unless illegal drugs or open alcohol bottles are in the car you shouldn't get in trouble

No You Will Not Get In Trouble, The Other Person Will Get A Ticket And The Car Could Get Towed But If The Officer Is Nice And Someone Else In The Car Has License Then They Will Let Them Drive

WoW!! The gullibility of some people.
If you are the registered owner of a vehicle and you tell the officer you knew the person didn't have a valid license, you need to have your license suspended too.
IF, you are in a vehicle just riding as a passenger, theirs not a dam thing the cops can do to you. In alot of cases, the police will simply take the suspended person to jail and/or let you go with the vehicle if the arrested person gives authorization.

The simple act of being in a car with an unlicensed/suspended driver is not a crime in any state that I'm aware of. However, knowingly letting somone without a license drive your vehicle IS a crime in several states, but it's hard to prove.

The bottom line is, as long as you're not involved in any other criminal activities, you should be fine.

If you own the vehicle, you are responsible for ensuring the driver is legally allowed to drive. If you have reason to know the driver is not properly licensed, you may be liable. If neither of these is true, you should not be in trouble. You may even be asked to drive the car home to avoid impounding it.

Not that I'm aware of. But.. the license was suspended for a reason. Why would you get in his car with him behind the wheel, instead of driving yourself??

You have no way of knowing whether that person had a valid license or nor. What are you supposed to do? Hold them down and look at their license against their will? Use some common sense when you've heard things from someone.

only if it is your car they are driving. if its your car you are responsible for making sure that the person you let drive you car has a valid license. my sister got fined for driving my car with expired registration (by 2 days lol) the officer told her she should have checked that before she drove even if it wasn't her car.

I would think that the only way that could happen is if you are the registered owner of the car that's being driven. Other than that, the answer is no.

was the car yours? Did the person get into a accident with your car? was the car insured? when you say "Letting the person drive" what did you mean?
