i am seeking a restraining order for my three year old. the person i want to be protected from molested my daughter. this is still under investigation. it is her father, so he was court ordred unsupervised visits before the molestation began.
he has a history of violent crimes, one with a gun. he has two felonies and has had many restraining orders against him. i applied a few days ago. how likely am i to get this? we are in california.

i will call these people for sure! i am so happy that there is so much help for people who have been sexually abused. as soon as we reported, which was immediately, we had a group of people, deputy sheriffs, a deputy district attorney, and several victims advocates ready to help my daughter. I thank God for people like that.

They may order supervised visits while they investigate...BUT>>>If you make the allegation and lose....you may have big trouble....there have been to many Moms that cry this when they are in divorce proceedings or want to get back at the husbands...it has gotten so bad that the police now file charges at women if they discover no evidence...good luck...but you NEED to talk to a LAWYER they will know what is best

I do not know where you live, but try to get it extended. You may also ask the judge (depending on the state) to asign an advocate for the children. California can get a little strange about this stuff, for example, denying a biological father visitation, but allowing the child to be put into athe mother's home where a child molester resides. If possible, see if you can also move somewhere else, as far away as possible. Your childrens safety is what matters most at this time. If anyone knows that I am wrong, let me know, and steer this person on the right path.

In most situations such as yours, the Court almost always either extends the Court Ordered Protection even without having to file for it especially when it involves a child. Furthermore with a record like you say he has your probably a shoe-in for the granting of the Order. Until the case is settled the child should not be allowed even to visit un-supervised as he could grab her and run. My Heart goes out to you.

You will probably get it granted, but they may amend it to allow supervised visits until the guy is convicted or at least indicted.

Why do you have a kid with a guy like this?

I am almost positive you will receive one. I hate that first comment also. Reading your post almost made me cry. I pray for you and your little girl. I hope her father is buried under the jail. I will keep you two in my prayers.

I hope you get the restraining order. The bastard should be strung up by his testicles.
