i want to kick out the contractor that is working on my wood floors in my home. he is incompetent and has not done the job properly. plus many other problems! i only gave him a small deposit, and there is no signed contract. he has his equipment in my home, and i want to tell him to pack his stuff and leave. i have had it with him, and i don't trust him anymore.
please give me advice in doing this. thanks.

It's not that simple! You will need proof of his incompetence if he takes you to court. TAKE PICTURES. of every thing that's gone wrong! Take plenty of pictures.

In most states, an oral contract is the same as a signed piece of paper. He can take you to small claims court and the magistrate most often splits the money amount asked for. Then you will wind up paying for his incompetence.

I just had the same type of thing happen to me. I hired a bricklayer that couldn't lay a brick if it had hair on it! When I showed the magistrate the pictures and made that statement, he laughed so hard he granted me all of my money back. But, I still don't have the money! The contractor is appealing.

Yes,But do not damage his equipment and take pictures of that also to cover yourself take inventory of his stuff you can do what you want document everything he has done wrong take pictures.Make sure you give him or have a reciept (s) and get a second opinion if you can to back up what you think he has done wrong. You Must prove his incompetence.
