my sisthers boyfriend was arrested for driving without a license. he lost his license casue of a dwi charge. he has violated his probation for the 2nd time.

Whatever is the maximum time for the original charge convicted of.

Your question is not very clear. What was the original charge?

I'm going to assume he was nailed for a DUI and they suspended his license and put him on probation. O.K., now he has been caught a second time driving while the license is suspended.

If the above is correct, then:

keep in mind that these are misdemeanor traffic offenses. Most states limit the jail time for a first time DUI to six months, sometimes a year. Driving under Suspension usually just carries a stiff fine, maybe 30 days to six months in jail.

Will he do any jail time? Kinda depends on a couple factors. Is he a jerk that stays in petty trouble like this; someone who the judge and cops almost know on a first name basis. Then yep, he could do some time, judges hate "frequent flyers". Second factor is how crowed is the jail. Many courts are reluctant to tie up jail beds for minor traffic offenses when they need room for a real criminal.

so, if he's just been stupid a couple times, maybe a stiff fine will get his attention. If he does actually do any time, I'd be surprised if it was more than 30 days.

It depends on the severity of the charge, as well as the municipality in which it was committed. Other factors are representation and who you have for a judge. For this charge, expect 5 years. Parole in 1 or 2.

Just a guess. I'd say whatever time they could have received for the original crime plus time for whatever they did to violate the probation.

If the Jails not overcrowded, whatever time he received when he was sentenced is the time he'll have to serve. If he was given 2yrs. then released on probation, then when your violated, you serve that 2yrs.
